A concerned citizen called the police to report a drunk driver and followed the car until it stopped in the driveway/front-yard of a residence. The police arrived and found the driver/client to be “passed-out” behind the wheel. The client admitted to drinking vodka and could not recall how much. While on video, the client performed poorly on the field sobriety exercises and was arrested. A breath test result of .337/.336 was subsequently obtained. In court, we filed several pre-trial motions (resulting in the breath-test being thrown-out) and had multiple hearings in an effort to have the case dismissed completely. Ultimately, the State agreed to drop the DUI to a Reckless Driving, and the client accepted the offer to plea to the reduced charge. |
