Client stopped for driving erratically and admitted to drinking “too many”. Officer did DUI investigation and arrested the client, who had a .23/.22 breath test result. We filed several pre-trial motions challenging the legality of the stop made by the officer, and suppressing the breath test. The motions caused the State to drop the DUI charge to a Reckless Driving.
